Audubon will follow strict guidelines when posting stories and photos to the Pennies for the Planet Honor Roll to protect the rights and identities of the children participating in Pennies for the Planet, a conservation-related fundraising campaign. If you are a parent submitting your child’‘s name on the Honor Roll, along with classroom, city/state, story and photo, you will be asked to consent to Audubon publishing the content online and in other publications. If you are a teacher submitting this same information, on the other hand, Audubon will only publish the first name of a child or children, or the classroom name (e.g. Ms. Blank’‘s 3rd Grade baking class), along with city/state and story. The only teacher-submitted photos that will be published are images of unrecognizable children, or of inanimate objects such as children’‘s artwork, a class bulletin board or other images connected to the fundraising. For a child’‘s likeness/image to be published when submitted by a teacher, the teacher must obtain signed photo model releases from the parent or legal guardian of the children in the photos and copies of those signed releases must be submitted to Audubon. If you are a minor submitting your own story to the Honor Roll, and you are under the age of 13, you must ask permission of your parent or legal guardian before sending any information over the Internet. If you are a minor under the age of 18, Audubon will publish only your first name unless we are specifically authorized by your parent or guardian to publish more information about you. Likewise, Audubon will not publish a photo of you or another minor unless Audubon is given written permission by the minor’‘s parent or guardian. Indemnity You agree to defend, indemnify and hold harmless Audubon, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’‘s fees) arising from: (a) your use of and access to this site; (b) your violation of any term of these Terms & Conditions; (c) your violation of any third party right, including without limitation any copyright, trademark, property, or privacy right; (d) your violation of any obligations, representation or warranties hereunder; or (e) any claim that one of your User Submissions caused damage to a third party.
